§ 1 Scope

(1) These Terms of Use ("Terms") govern access to and use of the online platform holoblox.org (hereinafter: "Platform"), including all content, services, and features provided therein, in particular the ability to create and publish articles.

(2) These Terms apply to all users, regardless of whether they merely view publicly accessible content, register for a user account, or access advanced functions while logged in.

(3) By using the Platform, the user legally and bindingly acknowledges the validity of the current version of these Terms of Use as well as the Privacy Policy and the User Guidelines. Any person who does not agree with these provisions is not permitted to use the Platform.

§ 2 Registration and Use of Article Creation

(1) The ability to create and publish articles is reserved exclusively for registered and logged-in users.

(2) Registration is voluntary but requires the complete, accurate, and current disclosure of all required information. Registration under a false identity or with incorrect data is prohibited.

(3) By registering, the user acknowledges the binding effect of the Terms of Use, the User Guidelines, and the Privacy Policy, and undertakes to independently and regularly review these documents in order to remain informed of any changes. Amendments become effective upon their publication on the Platform.

(4) Once an article is submitted, it is automatically published without prior review by the operator. The article then becomes globally visible without access restrictions. Subsequent editing or deletion by the user is excluded. Full responsibility for the article remains with the author.

(5) The operator is entitled to store and process all IP addresses in connection with registration, login, and use, in accordance with Art. 6(1)(f) GDPR, in particular to ensure the security and stability of systems, to prevent misuse and fraud, and to enforce these Terms of Use and the User Guidelines.

(6) The user agrees that the operator may send them mandatory emails related to the use of their account. These include in particular:

  • Two-factor authentication codes and security notifications,
  • Notifications regarding new or modified functions,
  • Notices of changes to the Terms of Use, the User Guidelines, and the Privacy Policy.

Such communications are strictly necessary and cannot be unsubscribed from.

§ 3 Public Visibility and Accessibility

(1) All submitted articles are, upon publication, globally accessible without restriction and beyond the operator's control.

(2) On each article page, the username of the user who submitted the article will be explicitly and visibly displayed as the author.

(3) Users acknowledge that even after deletion by the operator, published content may remain accessible via third parties, caches, or archiving systems. Complete removal from the internet cannot be guaranteed.

(4) For detailed provisions regarding the visibility and use of content, reference is made to the User Guidelines.

§ 4 Prohibited Content

(1) The creation and publication of articles or other content is prohibited if such content violates applicable law, these Terms of Use, or the User Guidelines.

(2) Instead of an exhaustive list, reference is expressly made to the User Guidelines, in which prohibited content and behaviors are defined in detail.

(3) The operator is entitled to block or delete any such content without prior notice.

§ 5 User Responsibility

(1) Each user bears sole legal and factual responsibility for all content they submit.

(2) The user shall indemnify and hold harmless the operator from all third-party claims arising from the creation, publication, or dissemination of their content, and undertakes to fully compensate the operator for any damages, costs, or reasonable legal defense expenses incurred.

§ 6 Publication, Moderation, and Removal

(1) All submitted content will be automatically published upon submission and will be visible to all visitors.

(2) The operator may block, delete, or modify content at any time without notice, if there are specific indications of a violation of these Terms of Use, the User Guidelines, or applicable law.

(3) Users have no claim to publication or the continued availability of submitted content.

§ 7 Prohibited Conduct, in Particular Unauthorized Interference (Hacking, Exploits, Disruption)

(1) Users are strictly prohibited from engaging in actions that impair or attempt to impair the security, confidentiality, integrity, or availability of the Platform's systems. This includes in particular, but is not limited to:

  • unauthorized access to system areas, networks, accounts, administrative interfaces, or databases ("hacking"),
  • exploiting, testing, scanning, or deliberately causing vulnerabilities, security flaws, misconfigurations, or other weaknesses in the Platform's hardware or software (exploits),
  • distributing or deploying malware, ransomware, trojans, viruses, worms, or comparable programs,
  • carrying out Distributed Denial of Service (DDoS) attacks or other activities aimed at impairing or disabling the availability of the Platform,
  • manipulating, altering, interrupting, or interfering with data traffic, content, or communication pathways,
  • circumventing, disabling, or interfering with technical, organizational, or contractual security measures, such as authentication, encryption, or access control.

(2) Such actions are unlawful and may result in civil and criminal consequences. The operator reserves the right to immediately implement technical countermeasures, including the blocking of accounts, IP bans, blacklist entries, routing restrictions, suspension of affected services, or other suitable defense measures.

(3) In addition, the operator is entitled to notify law enforcement and security authorities without delay and to disclose relevant data (including connection/log data and IP addresses) to such authorities for the purposes of prosecution, evidence preservation, and hazard prevention, insofar as legally permissible.

(4) The operator is further entitled to secure, evaluate, and use technical protocol data, log files, and other records as evidence in order to investigate and enforce rights. This includes in particular the storage of IP addresses, timestamps, requested resources, user agent strings, and other connection metadata.

(5) Without prejudice to other claims, the operator reserves the right to assert damages in cases of culpable violations, including compensation for damages, expenses, and reasonable legal defense costs.

§ 8 Operator's Rights

The operator reserves the following rights in particular:

  • to modify, restrict, or discontinue the Platform or parts thereof at any time without prior notice,
  • to exclude users from creating articles if they violate these Terms of Use or the User Guidelines,
  • to implement technical measures such as IP blocking, account deactivation, or access restrictions,
  • to notify law enforcement authorities and cooperate with them in cases of suspected unlawful activity.

§ 9 Liability

(1) Use of the Platform is at the user's own risk.

(2) Users are fully liable for all damages or legal consequences arising from their content, actions, or omissions on the Platform.

(3) The operator assumes no liability for user-generated or third-party content and makes no warranties regarding its accuracy, legality, or completeness.

§ 10 Amendments to the Terms of Use

(1) The operator may amend these Terms of Use at any time with effect for the future.

(2) The version published on the Platform shall be decisive.

(3) Continued use of the Platform after the publication of a new version constitutes acceptance of the amended Terms of Use.

§ 11 Final Provisions

(1) If any provision of these Terms of Use is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

(2) The laws of the Federal Republic of Germany shall apply exclusively, excluding its conflict-of-law rules.

(3) To the extent legally permissible, the place of jurisdiction shall be the registered office of the operator.
